These Terms of Service ("Terms") constitute a binding agreement between you and Eloya Technologies ("Company", "we", "us", "our") regarding your use of the Tamil Creator website, platform, and services (collectively, the "Service").

By accessing or using Tamil Creator, you agree to be bound by these Terms. If you do not agree to any part of these Terms, you may not use the Service.

1. Use License

We grant you a limited, non-exclusive, non-transferable license to access and use Tamil Creator for lawful purposes only. You agree not to:

Reproduce, duplicate, or copy content from Tamil Creator without permission
Sell, trade, or exploit the Service or its contents
Reverse engineer, decompile, or disassemble the Service
Attempt to gain unauthorized access to the Service or its systems
Use the Service for any automated scraping or data extraction

2. Guest Mode and User Accounts

2.1 Guest Mode Limitations

Tamil Creator offers a "Guest Mode" for users who do not create an account. Guest mode users:

Have limited access to features compared to registered users
Cannot save projects or generation history
Sessions are not persisted across browser restarts
Cannot subscribe to premium features
May have lower priority for resource allocation

2.2 Account Registration

If you create an account:

You are responsible for maintaining the confidentiality of your password
You agree to accept responsibility for all activities under your account
You represent that information provided during registration is accurate and complete
You must be at least 13 years of age to create an account

2.3 Account Suspension

We reserve the right to suspend or terminate your account if you violate these Terms or engage in abusive behavior.

3. Tool Disclaimer - "As-Is" Basis

IMPORTANT DISCLAIMER:

The OCR (Optical Character Recognition) and Font generation tools ("Tools") are provided on an "AS-IS" basis without any warranty, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

3.1 OCR Tool

The OCR tool is designed to extract text from images. We make no guarantees regarding:

Accuracy of text extraction
Handling of complex layouts or handwritten text
Preservation of formatting
Support for all languages or scripts

You are responsible for verifying the accuracy of extracted text before using it.

3.2 Font Generation Tool

The Font generation tool creates custom Tamil fonts. We make no guarantees regarding:

Compatibility with all applications or devices
Quality or aesthetic appeal of generated fonts
Rendering accuracy across different platforms
Performance or load times

We recommend testing generated fonts in your target environment before production use.

3.3 No Liability

To the maximum extent permitted by law, Eloya Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use the Tools, including but not limited to:

Loss of data or business revenue
Errors in text extraction or font generation
Compatibility issues with third-party applications
Service interruptions or downtime

4. User Conduct and Anti-Abuse Policy

You agree not to use Tamil Creator for any abusive, unlawful, or harmful purposes. Prohibited conduct includes:

4.1 Abusive Scripts and Bots

You agree not to:

Use automated scripts, bots, or tools to abuse the Service
Attempt to bypass rate limiting or abuse detection systems
Perform repetitive requests exceeding reasonable usage limits
Use the Service to generate spam or distribute malware
Conduct denial-of-service (DoS) attacks against the platform

Accounts violating anti-abuse limits will be subject to:

Temporary rate limiting or suspension
Permanent account termination
Legal action if applicable

4.2 Illegal Activity

You agree not to use the Service for:

Illegal content generation or distribution
Fraud, phishing, or impersonation
Intellectual property infringement
Harassment, threats, or hate speech

4.3 Content Responsibility

You are solely responsible for:

Any content you upload or generate using the Service
Ensuring you have the right to use and distribute such content
Compliance with all applicable laws and regulations

5. Intellectual Property Rights

All content, features, and functionality of Tamil Creator (including but not limited to text, graphics, logos, and software) are owned by Eloya Technologies or its licensors and are protected by copyright, trademark, and other intellectual property laws.

Generated content (extracted text, created fonts) may be used by you for personal or commercial purposes, provided you comply with these Terms and applicable laws. You retain ownership of any original content you upload; we retain the right to store and process it to provide the Service.

6. Subscriptions and Pro Features

6.1 Pro Subscription Terms

The "Pro" subscription grants you access to premium features including increased usage limits and priority support. Subscriptions are charged monthly or annually based on your selection.

6.2 Billing and Payment

Payments are processed securely through Dodo Payments. By subscribing, you authorize us to charge the payment method you provide. You agree to:

Keep your payment information accurate and up-to-date
Pay all charges incurred under your account
Notify us of unauthorized charges immediately

6.3 Cancellation and Refunds

You can cancel your Pro subscription at any time. Please refer to our Refund Policy for detailed information about refunds and cancellation procedures.

6.4 Price Changes

We reserve the right to change subscription prices with 30 days' notice. Existing subscribers will maintain their current price for one billing cycle before the new price takes effect.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Eloya Technologies, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Our total liability under these Terms shall not exceed the amount you have paid us in the 12 months preceding the claim.

8. Indemnification

You agree to indemnify, defend, and hold harmless Eloya Technologies and its officers, directors, employees, and agents from any claims, damages, or costs (including legal fees) arising from:

Your use of the Service
Your violation of these Terms
Your infringement of third-party intellectual property rights
Content you upload or generate

9. Modifications to Service

We reserve the right to modify, suspend, or discontinue Tamil Creator (or any part thereof) at any time with or without notice. We are not liable for any modification, suspension, or discontinuation of the Service.

10. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the jurisdiction where Eloya Technologies is registered, without regard to its conflict of law principles. Any legal action or proceeding shall be brought exclusively in the courts of that jurisdiction, and you consent to the personal jurisdiction and venue of such courts.

11. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

12. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Eloya Technologies regarding your use of the Service and supersede all prior agreements and understandings.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms on this page and updating the "Effective Date" above. Your continued use of Tamil Creator following any changes constitutes your acceptance of the updated Terms.
